Gratuity = last basic + DA × 15 ÷ 26 × years of service
Under the Payment of Gratuity Act a final part-year of more than six months counts as a full year. Employers outside the Act use 15 ÷ 30 and completed years. Nothing is due before 5 years (1 year on a fixed-term contract). The Act pays up to ₹20 lakh, and up to ₹20 lakh is free of income tax.

Last basic pay + DA × 15 ÷ 26 × years of service, for an employer covered by the Payment of Gratuity Act. A final part-year of more than six months counts as a full year. Employers not covered use 15 ÷ 30 and completed years only.
Five years of continuous service, which this calculator applies. Some High Courts (Madras, in Mettur Beardsell v. Regional Labour Commissioner) have treated 4 years and 240 days worked in the fifth year as five years, so ask your employer if you are close. Fixed-term employees qualify after one year under the Code on Social Security, in force since 21 November 2025. On death or disability, the five-year rule does not apply.
For private sector employees, up to ₹20 lakh in a lifetime is free of income tax. Government employees' gratuity is fully tax free.
The Act caps gratuity at ₹20 lakh. An employer may choose to pay more; the part above ₹20 lakh is taxable.
